FavNFresh is an online marketplace that connects farmers, food vendors, and consumers. We facilitate transactions between buyers and sellers of fresh produce, homemade foods, and related products. We are not a party to any transaction between users and do not take title to any products sold through our platform.

3. User Accounts

To use certain features of our Platform, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and identification
• Accept all responsibility for activities that occur under your account
• Notify us immediately of any unauthorized use of your account

4. Vendor Responsibilities

If you are a vendor (farmer, food maker, or retailer) on our Platform, you agree to:

• Comply with all applicable food safety regulations and laws in your jurisdiction
• Provide accurate product descriptions, pricing, and availability information
• Fulfill orders in a timely manner and as described
• Maintain all necessary licenses, permits, and certifications
• Handle customer inquiries and complaints professionally
• Comply with our US compliance requirements for your state and vendor type

5. Consumer Responsibilities

As a consumer, you agree to:

• Provide accurate delivery information
• Pay for all orders placed through your account
• Review product descriptions and vendor information before purchasing
• Contact vendors directly for product-specific questions
• Report any issues or concerns promptly

6. Payments and Fees

All payments are processed through secure third-party payment processors. We charge platform fees to vendors, which are clearly disclosed during the onboarding process. Consumers pay the listed price plus applicable taxes and delivery fees. All prices are in the currency specified for your region.

7. Returns and Refunds

Return and refund policies are determined by individual vendors. We facilitate communication between buyers and sellers regarding returns and refunds but are not responsible for vendor refund policies. If you have issues with a purchase, please contact the vendor directly or reach out to our customer support team.

8. Prohibited Activities

You agree not to:

• Use the Platform for any illegal purpose or in violation of any laws
• Post false, misleading, or fraudulent information
• Infringe on the intellectual property rights of others
• Harass, abuse, or harm other users
• Interfere with or disrupt the Platform's operation
• Attempt to gain unauthorized access to any part of the Platform
• Use automated systems to access the Platform without permission

9. Intellectual Property

All content on the Platform, including text, graphics, logos, images, and software, is the property of FavNFresh or its content suppliers and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from any content without our express written permission.

10. Limitation of Liability

FavNFresh acts as a marketplace facilitator and is not responsible for the quality, safety, or legality of products sold by vendors. We do not guarantee that the Platform will be error-free or uninterrupted. To the maximum extent permitted by law, FavNFresh disclaims all warranties and shall not be liable for any indirect, incidental, special, or consequential damages.

11. Indemnification

You agree to indemnify and hold harmless FavNFresh, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Platform, violation of these Terms, or infringement of any rights of another.

12. Termination

We reserve the right to terminate or suspend your account and access to the Platform at our sole discretion, without notice, for any reason, including breach of these Terms. Upon termination, your right to use the Platform will immediately cease.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Platform after such modifications constitutes acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Platform shall be resolved in the courts of Georgia.
